Engine Makers Group Files Lawsuit Against CARB

he Engine Manufacturers Association said it filed a lawsuit against the California Air Resources Board, seeking to overturn the agency’s requirement that engine manufacturers upgrade emission-reduction software on many trucks operating in the state.

EMA President Jed Mandel said manufacturers had complied with CARB’s March 2004 voluntary retrofit plan. At that time, EMA officials had said the voluntary approach by the state regulatory agency was the “right way to go.”

But, Mandel said, CARB’s December decision to drop the voluntary program and require upgrades by the end of April 2005 was an “unauthorized” mandate that changed the terms of the previously negotiated settlements.
