ATA Brief Rebuffs Solicitor General on L.A. Port Case

The legal argument cited by the U.S. Solicitor General opposing a U.S. Supreme Court review of the Port of Los Angeles clean trucks plan is “terribly wrong,” American Trucking Associations said in a response brief filed Monday.

ATA’s response was filed less than two weeks after the Solicitor General said that while he agreed that the 9th U.S. Circuit Court of Appeals ruled erroneously in allowing the port to impose several requirements on drayage operators, he still asked the high court not to review the case.

Those requirements were for carriers working at the port to submit an off-street parking plan, properly maintain their trucks, post placards on permitted trucks and demonstrate financial capability.

ATA has called the port’s clean trucks requirements “burdensome” for truckers.
