Transmission Case Against Eaton Advances

Plaintiffs in a suit against Eaton Corp. and major truck manufacturers claimed a victory after a federal judge turned aside defendants’ efforts to dismiss the case.

Tauro Brothers Trucking and the trustee for bankrupt Performance Transportation Services Inc. brought the action last year, alleging price-fixing on transmissions sold by Eaton to truck makers.

The decision announced Sept. 30 by U.S. District Judge Sue Robinson rejected Eaton’s motion to dismiss the case, which is in its early stages, company spokesman James Parks said.

“Eaton believes that it has, at all times, competed fairly and lawfully and, consistent with company policy, will not comment further on pending litigation,” Parks said.
