About 50 Carriers Opt Out of Pilot Settlement

Only about 50 of the 6,000 Pilot Flying J customers who were eligible to participate in a rebate-fraud class action lawsuit settlement have formally declined to participate in the settlement, Pilot’s attorney said.

Aubrey Harwell, Pilot’s attorney, told Transport Topics late Oct. 16 that he won’t know the final count of opt-out customers for a few days, even though that day was the deadline. “Even if it’s as high as 100, that’s pretty amazing when you look at the fact that there were 6,000 Pilot customers who bought fuel during the time period stipulated in the settlement,” he said.

More than two dozen lawsuits have been filed against Pilot since the company’s Knoxville, Tenn. headquarters was raided by the FBI in April.

Pilot customers who are eligible to participate in the settlement include those who purchased over the road diesel fuel for commercial use in Class 7 and Class 8 vehicles and participated in Pilot Flying J “cost-plus” or “retail-minus” rebate or discount programs between Jan. 1, 2005 and July 15, 2013.



The settlement does not include retail discounts given for payments made by cash, check or major credit card at the point of sale.
