ATA Files Appeal in SoCal Ports Case

American Trucking Associations has filed an appeal with the Ninth Circuit Court of Appeals, claiming that a lower court did not follow the circuit court's directions in granting an injunction in its continuing fight with the ports of Los Angeles and Long Beach, the Long Beach Press-Telegram reported.

After the circuit court remanded ATA’s request for an injunction against the concession plans of the ports' Clean Truck Program earlier this year, Judge Christina Snyder granted an injunction against key parts of the plan. But ATA said in its appeal that the circuit court asked that the concession plans be removed entirely, the Press-Telegram said.

ATA has asked the court to block provisions requiring companies to keep records on driver training, vehicle maintenance and insurance, among other records, as well as a rule that trucks carry radio frequency identification tags, the Press-Telegram said.

ATA Spokesman Clayton Boyce told the Press-Telegram that the remaining concession provisions are unrelated to the ports' goal of replacing old diesel trucks.
