ATA Joins Court Fight Against Tax

American Trucking Associations last week urged the U.S. Supreme Court to declare a Washington state truck tax unconstitutional.

Its Litigation Center wants the justices to reverse a lower court ruling that declared the $48-a-truck regulatory fee constitutional.

Last year, the state Supreme Court ruled that such fees for safety enforcement activities did not have to be fairly apportioned.

In a brief filed last week, the ATA agency argued that the fees, as well as taxes, must be fairly apportioned under the commerce clause of the U.S. Constitution.
