Calif. Board Rejects Exhaust Appeal

A California board rejected an appeal by industry groups to reconsider its decision to label diesel exhaust particulates as a toxic air contaminant.

Several groups, including American Trucking Associations, California Trucking Association, Engine Manufactur-ers Association and Truck Manufacturers Association, petitioned the California Air Resources Board in July to declassify diesel particulates as toxic, based on studies that had come to light since the board’s original August 1998 decision (7-12, p. 3).

The board responded by saying that the new evidence consisted of interpretations of studies the board had previously considered.

The California Trucking Association plans to file a lawsuit in October to get the board to alter its diesel particulates decision.
