California Air Agency’s Authority Gets Mixed Court Verdicts

he California Air Resources Board saw its authority to regulate truck emissions challenged in the state courts, which returned mixed verdicts for the environmental regulatory agency in 2006.

California’s Superior Court on Oct. 16 overturned a CARB regulation that required all trucks with 1993-98 model-year engines operating in the state to be reprogrammed to include more stringent emission controls.

On Feb. 23, a state court issued a decision supporting the board’s designation of diesel-particulate matter as a toxic air contaminant — despite a lawsuit brought by American Trucking Associations and other industry groups seeking to overturn the designation.
