Court Orders Formal Arguments in Oregon Ton-Mile Tax Dispute

A state circuit court wants to weigh the arguments in American Trucking Associations’ lawsuit against Oregon’s weight-distance tax, and has denied both parties’ motions for summary judgment.

In its attempt to knock out the nation’s oldest weight-distance, ATA is targeting what it calls a “flat fee” in the tax system that is available to haulers of natural resources, such as logs, sand and gravel, but not to carriers of general freight.

ATA charges in its lawsuit that this alternative to the tax assessed on vehicle weight and distance traveled in the state is discriminatory.
