New Mexico Faces Challenge on Gas Fees

At the request of American Trucking Associations, the federal government is weighing whether New Mexico’s rules and fees for haulers of liquefied petroleum gas and compressed natural gas are legal.

ATA argues that New Mexico’s rules for certain gas carriers are pre-empted by federal hazardous materials transportation law.

New Mexico requires truckers who haul liquefied gas products to take written tests conducted in the state. Trucks engaged in such hauling are subject to annual inspection.

Lloyd Dean, vice president of operations for Basin Western, a Utah carrier that hauls petroleum products throughout the West, wrote a letter to the Research and Special Programs Administration, in which he called the rules “burdensome” to interstate carriers.
