Overnite To Appeal Court Decision On Teamsters

Overnite Transportation Co. said it will appeal a decision by a three-judge panel that would force the company to bargain with the Teamsters at four terminals where a majority of employees voted against union representation in 1995.

The decision is a setback for the Richmond, Va.-based less-than-truckload carrier, which has been battling an organizing drive since December 1994 when Kansas City, Mo., became the first of 22 terminals where a majority of workers voted to let the Teamsters represent them. The company maintains 167 terminals nationwide.

"We are disappointed. It's not the decision we were hoping for," said Ira Rosenfeld, director of corporate communications for Overnite.

The panel's 2-to-1 decision Feb. 16 upheld bargaining orders by the National Labor Relations Board on behalf of workers at Overnite terminals in Norfolk, Va.; Louisville, Ky.; Bridgeton, Mo.; and Lawrenceville, Ga. The case dates back to a 1997 ruling in favor of the union by an administrative law judge.
