The Pipeline and Hazardous Materials Safety Administration is seeking comment on two separate American Trucking Associations’ federal preemption petitions claiming that regulatory requirements for hazardous materials hauling in Pittsburgh and New York City impose unfair burdens on hazmat carriers.
ATA said that New York City requires that motor carriers file a separate application for each tractor or trailer and pay an “excessive” $210 fee for each to be inspected.
In Pittsburgh, only motor carriers are required to obtain a city permit and pay a $132 fee, but city officials cannot show proof that they are using the funds generated from permit fees for hazardous materials enforcement and emergency response training, ATA said.
Comments on the petitions, which were published in the Federal Register on April 17, will be accepted through June 2, PHMSA said. Rebuttal comments can be made until July 16 after which the agency will make an administrative decision on the petitions.
