Rail shipper groups are hailing a decision by the Surface Transportation Board that the Union Pacific Railroad overcharged FMC Corp. on some 2 million tons of chemical shipments over past three years.
FMC, based in Chicago, ships soda ash, sodium bicarbonate, phosphorus phosphate rock over UP lines.
ccording to Bloomberg News, the ruling represented the first time the STB or its predecessor, the Interstate Commerce Commission, had applied its maximum rail rate formula to any shipments other than coal. In cases involving coal shipments, shippers have won fewer than 10 since 1984.
“It’s a big win for shippers,” Ed Rastetter, director of policy for the National Industrial Transportation League, told Bloomberg.
