XPO Files Federal Civil Suit Against R+L Carriers
XPO Logistics, including the former Con-way Freight, filed a six-count civil complaint against R+L Carriers in U.S. District Court in Detroit, alleging that R+L acted illegally in raiding employees from XPO.
XPO filed first on Feb. 3 and also made allegations against three former Con-way Freight account executives: Jill Langley, James Matthews and Shawn Thackray. Both R+L and XPO’s Freight division are less-than-truckload carriers.
The complaint by XPO accused R+L, which is based in Wilmington, Ohio, of trademark infringement, “cybersquatting,” unfair competition and interference with employment contracts.
The three former Con-way employees are accused of breach of contract and misappropriation of XPO/Con-way trade secrets to R+L.
Greenwich, Connecticut-based XPO acquired Con-way Inc. in October, including Con-way’s LTL, truckload and logistics divisions. Earlier this month XPO also filed a civil suit against LTL carrier YRC Worldwide in Delaware Chancery Court.
Among LTL carriers on the Transport Topics Top 100 list of for-hire carriers, YRC ranks No. 2, XPO/Con-way is No. 3 and R+L is No. 8.
R+L was not available for comment on short notice.
