ATA Supports FMCSA, Intervenes in HOS Suit

aying it was concerned trucking could lose some of its operating flexibility, the American Trucking Associations said it has intervened on the side of the federal government in a lawsuit by Public Citizen that challenges the revised driver hours-of-service rule.

However, the federation will not file a legal action in a second, narrower challenge to the rule, Bob Digges, ATA’s deputy general counsel, told Transport Topics.

The motion to intervene, filed March 14 with the U.S. Court of Appeals for the District of Columbia Circuit, puts ATA on the same side of the legal battle as it was in 2004.
