FMCSA Says HOS Rule Reflects Safety, Cost Issues

he Federal Motor Carrier Safety Administration asserted in a court brief that the revised hours-of-service rule for truck drivers is based on safety concerns, research and the potential cost to the industry.

“The HOS rule reflects a careful balance of safety considerations, costs and benefits, and the practical effect of the rule on the regulated industry,” FMCSA said in its Aug. 10 brief.

Because claims made by both of the petitioners who are challenging the rules “are based upon little more than disagreement with FMCSA’s reasonable interpretation of the scientific evidence and comments in the record, their claims must be rejected,” the agency said.
